1. Platform Role

Haven is an advertising and listing platform that connects property owners, landlords, agents, and renters. Haven does not own, manage, or control any property listed on this platform, nor does it act as a real estate broker, agent, or representative on behalf of any party. Haven is solely a venue for third-party listings and bears no responsibility for the outcome of any rental transaction, inquiry, or interaction that occurs through or as a result of using this platform.

2. No Guarantee of Apartment Availability

Haven makes absolutely no guarantee, representation, or warranty that any apartment, unit, or property listed on this platform is actually available, accurately described, legally rentable, or suitable for any purpose. Listings may be outdated, inaccurate, or removed at any time without notice. Haven is not responsible if an apartment you contact is no longer available, was never available, or does not match its listing. You are solely responsible for independently confirming the availability and condition of any property before taking any action.

3. No Liability for Scams or Fraud

Haven is not responsible for any financial losses, theft, fraud, scams, impersonation, or deceptive practices carried out by any user, landlord, agent, or third party through or in connection with this platform. You use this platform entirely at your own risk. We strongly advise you never to send money, wire transfers, gift cards, cryptocurrency, or personal financial information to any party before viewing a property in person and independently verifying its legitimacy.

Haven does not verify the identity, credentials, licenses, or legitimacy of any person or listing on this platform. The presence of a listing or an agent profile on Haven does not constitute an endorsement, verification, or approval of any kind. Any transaction you enter into is solely between you and the other party — Haven is not a party to any such agreement and has no obligation or liability in connection with it.

If you believe you have encountered a scam or fraudulent listing, you should immediately contact your local law enforcement and, if applicable, report it to the Federal Trade Commission (FTC) at reportfraud.ftc.gov. Haven is not responsible for investigating or resolving fraud claims.

4. No Refunds

All payments made through Haven — including listing fees, broker profile fees, and any other charges — are final and non-refundable. By completing a payment you acknowledge and agree that no refund will be issued under any circumstances, including but not limited to dissatisfaction with results, a listing receiving no inquiries, early removal of a listing, account suspension or termination, or technical issues beyond Haven's reasonable control.

5. Agent & Broker Conduct

Haven is not responsible for the conduct, representations, actions, or omissions of any agent, broker, landlord, or owner who advertises on this platform. Any agreements, showings, negotiations, or transactions that occur between you and an agent or broker are entirely independent of Haven. Haven makes no guarantees regarding the quality, accuracy, professionalism, or licensing of any agent or broker listed on the platform.

Haven does not endorse any individual agent or broker. Users are advised to independently verify all credentials, licenses, and references before engaging any professional through this platform. Haven bears no liability for any harm, loss, or dispute arising from your engagement with any agent, broker, or landlord found on this platform.

6. Listing Accuracy

Haven does not verify the accuracy of any listing details, including but not limited to pricing, availability, square footage, amenities, pet policies, voucher acceptance, or photographs. All listing information is provided solely by the listing party. Haven assumes no responsibility for inaccuracies, omissions, or misrepresentations in any listing. You agree that Haven shall not be held liable for any decision you make based on listing content.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Haven, its owners, operators, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of — or inability to use — this platform, including but not limited to loss of money, loss of data, loss of opportunity, personal injury, property damage, or emotional distress, even if Haven has been advised of the possibility of such damages.

In no event shall Haven's total liability to you for all claims arising out of or related to this platform exceed the amount you have paid to Haven in the two (2) months preceding the claim, or one hundred dollars ($100), whichever is less.

8. Indemnification

You agree to indemnify, defend, and hold harmless Haven and its owners, operators, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of this platform; (b) any listing, content, or information you submit; (c) your violation of these terms; or (d) your interaction with any other user, landlord, agent, or third party through this platform.

9. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these terms or your use of this platform shall first be addressed by submitting a report through our platform. If unresolved, disputes shall be governed exclusively by the laws of the State of New York, without regard to conflict of law principles. You agree that any legal action shall be brought solely in the courts located in New York County, New York, and you consent to the personal jurisdiction of such courts. You waive any right to a jury trial in connection with any dispute arising from these terms or your use of this platform.

10. Account Termination

Haven reserves the right to suspend or permanently terminate any account at any time, for any reason, including but not limited to violation of these terms, suspected fraud, abusive conduct, or inactivity. Users may also delete their own account at any time from their account dashboard. Upon deletion, your personal data and listings will be removed from the platform. No refund will be issued for any fees paid prior to account deletion.

11. Changes to These Terms

Haven reserves the right to update these terms at any time without prior notice. The date at the top of this page reflects the most recent revision. Continued use of the platform following any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.
